TERMS AND CONDITIONS OF SALE

 
       
PAYMENT :   * We honor Visa, Master Card, American Express or Discover Cards and
  PayPal when presented in accordance with site instructions. eCheck is a
  payment option used (on-line only) through your own PayPal account.
  Checks and Money Orders mailed to our physical address are also
  accepted.
 
       
    * We accept paper checks and e-checks, but reserve the right to withhold
  merchandise shipments until checks have cleared.  Money Orders in US
  Funds will ensure prompt shipment.
 
       
    * Parts and Kit Prices subject to change without notice.  
       
    * Refunds will be made in the customer's *manner of payment*, i.e. credit card
  account debit or bank check, for ApogeeKits approved returns and items sold
  out or no longer available.
 
       
CANCELLATIONS :   * Cancellation of special orders for goods specially obtained by ApogeeKits
  for a specific customer will not be accepted once the order is processed.
  Cancellation of all returnable orders will be subject to a **restocking
  charge** of 15% of the value of the order.

* Some special order products listed on this website may be brightly and
  obviously labeled "NON-CANCELABLE and NON-RETURNABLE.
  ApogeeKits honestly and openly presents such products as special order
  and NON-CANCELABLE,  NON-RETURNABLE.  In such case, if an order is
  placed for such an item, the customer assumes all risk of suitability of the
  product for the customers intended purpose. Cancellations and/or returns
  of these products subsequent to the placement of the order will NOT be
  accepted after the order is processed. 
 
       
SHIPPING :   * ApogeeKits standard shipments are made via USPS (United States Postal
  Service, and UPS (United Parcel Service). Other shipping carriers are
  available to choose from at additional customer cost. Couriers other than
  the U.S. Postal Service will not deliver to P.O. Box addresses.

 * ApogeeKits reserves the right to UPGRADE your selected shipping option
   at NO additional cost to you if carrier carton size or weight restrictions
   prevent delivery using a shipping method you choose online, or if in the
   judgment of ApogeeKits the value of an order mandates shipping insurance
   or a receivers signature.

* Customers will pay return shipping charges for any product returns which
  ApogeeKits did not ship in error, or any other returns which ApogeeKits does
  not specifically authorize to be returned at our expense.

* International customers, please allow an additional 5 to 10 days for your
  shipment to clear through the Customs Service of your home country.
 
       
 INTERNATIONAL ORDERS   All International Orders  (all customers outside the U.S.A.)  
    *  ApogeeKits is happy to serve foreign customers where there are no
   international restrictions on the trade of the materials to be shipped.
   Please do not place an on-line order using the U.S. domestic shipping
   options listed in our website shopping cart.

  International shipping rates vary greatly depending on the size and weight
  of the package, and the destination country.  Please email our
  sales department for a specific shipping quote. When doing so, please list
  your desired item(s) and quantity, and full destination address details. We
  will be happy to respond with specific quotes using several shipping options
  for international customers to choose from. Then, if you tell us which of our
  quoted shipping options you prefer to use, we will program your selected
  "custom" international shipping method into our secure on-line shopping
  cart system for your on-line payment by credit card (or PayPal ) without
  the need for expensive international phone calls.

  For high value international orders (generally over $100 U.S.), ApogeeKits
  may quote the payment method by direct wire transfer or Western Union
  instead of by credit card. In this case the on-line shopping cart is not
  required and the quoted order will ship after the wired payment received
  in U.S. funds have cleared.

  All payments must be sent in U.S. funds only. ApogeeKits will not pay
  currency conversion fees to convert foreign currencies to U.S. dollars.

  Credit card payments to ApogeeKits from foreign customers are
  automatically converted by the credit card banks to U.S. dollars at the
  current rate of exchange. However, any direct wire transfer or Western
  Union payments not received in U.S. dollars will be refused and returned
  to the sending customer.

  ApogeeKits ships all international orders with properly prepared customs
  forms. The package contents and value will be accurately declared. Please
  allow an additional 5 to 10 days for your shipment to clear through the
  Customs Service of your home country.

 
       
REPORTING A ROBLEM OR MAKING RETURNS :   Orders shipped to USA and Possessions  
      Order problems: Orders are checked carefully for accuracy before they are
  shipped. Exact package weight including all packaged items are recorded for
  future reference. However, human error can occur. Check your order when it
  arrives.
  Customers must report order problems or packing errors to ApogeeKits within
  7 days of receiving the order. An RMA will be issued to return wrong items
  shipped or ordered items missing will be corrected.

  All damaged goods delivered to the Customer must be reported to ApogeeKits
  within 7 days of customer receipt.  ApogeeKits will restore/replace damaged
  item(s) to original condition.

  All non-damaged goods: Customers must notify ApogeeKits within 30 days of
  any and all non-damaged items customer wishes to return for replacement or
  refund. ApogeeKits will issue customer an "RMA" shipping authorization number
  and furnish shipping instructions for appropriate returns.

  Some returns may be subject to a **restocking charge** of 15% of the value of
  the order. Please see "Authorization to ship" paragraph (below).
 
       
    All orders shipped outside the USA  
      Uninsured Orders: ApogeeKits generally includes shipping insurance costs with
  international shipping quotes and ships international orders with insurance.
  International customers requesting or selecting un-insured shipping options do so
  at their own risk, and assume all risk of loss of shipment or product damage.
 
      Insured Orders:  ApogeeKits will restore/replace damaged item(s) to original
  condition.
 
       
    All return shipments
  The Customer is responsible for shipping charges for all returns unless
  specifically authorized by ApogeeKits to ship returns at factory expense.
 
       
    Authorization to ship
  Before shipping or returning any material for any reason, contact ApogeeKits by
  e-mail, phone, fax or US Mail for factory authorization to Ship.
  Identify customer name and address, reason for return and detail item symptoms if
  being returned for technical repairs. ApogeeKits will furnish an "RMA" shipping
  authorization and shipping directions for appropriate returns. Some returns may
  be subject to a **restocking charge** of 15% of the value of the order.
 
       
   

ApogeeKits pre-tests many of our factory assembled products such as
  lamps, magnifiers, and other items before we ship them, to help ensure
  customer satisfaction and reduce the need for unexpected returns.
  However, some delicate user replaceable parts on some of these items, such as
  light bulbs, may not survive through shipping, and are not warrantable items.
  ApogeeKits does not carry or ship replacement light bulbs.

 
       
    All product returns must be authorized by ApogeeKits before shipment;
  under no circumstances will returns be accepted if not pre-authorized.

    PRODUCT SPECIFICATIONS  
       
CONFIGURATIONS :   * Specifications are subject to change; we strive to continually improve and
  update our products. With your prior approval, ApogeeKits may use
  substitute material to replace parts that are out of stock or discontinued with
  parts of an equivalent nature.
 
       
    * ApogeeKits will include appropriate documentation and/or other instructional
  material within any change affected kit(s) to insure the kit builder has adequate
  assembly instructions.
 
       
    All ApogeeKits Brand kit contents include the following items:  
       
           * Custom manufactured printed circuit cards  
           * All required functional components  
           * Clear, concise, illustrated assembly instructions  
           * Kit electronic schematic drawing(s)  
           * Packing List  
   


All other brand electronic kit and tool products marketed and sold by
  ApogeeKits Electronic Kits and Tools website will include materials and
  documentation as furnished by the original kit or tool product manufacturer.

 
       
    PRODUCT GUARANTEE  
       
KIT REFUND :   * All ApogeeKits kits are rated for builder's degree of difficulty. If you determine
  that you can not safely or successfully assemble a kit you purchase from us,
  you can return the kit in its original retail condition for a credit in manner of
  payment* (less postage and packing/shipping charges) under the Project Kit
  Refund Policy.  Kits may NOT be returned under the Project Kit Refund Policy
  once construction has begun or after any sealed component packaging has
  been opened.
 
       
    * Returns under the Project Kit Refund Policy must be made within 30 days of
  original purchase. Some returns may be subject to a **restocking charge** of
  15% of the value of the order.
 
       
    * Refunds under the Project Kit Refund Policy subject to "as shipped" restrictions;
  i.e. no parts mounted, missing or modified; no soldering; kit content complete and
  intact as originally shipped from ApogeeKits.
  Restocking charges** may apply.
 
       
    * ApogeeKits reserves the right to refuse a return if materiel is not in "as shipped"
  condition.
 
       
    * Customer is responsible for shipping charges for all returns delivered as
  ordered.
 
       
    * All returns must be authorized by ApogeeKits before shipment; under no
  circumstances will returns be accepted if not pre-authorized.

KIT GUARANTEE :   * There is a limited warranty on all our kit products.  
       
    * The guarantee on our electronic project kits is limited to the replacement of
   faulty components only. ApogeeKits cannot guarantee the quality of the
   assembler's labor.
 
       
    * All ApogeeKits designs are tested and construction proofed before they are
  released for sale.  ApogeeKits uses standard production quality components
  from known and regular suppliers.  All ApogeeKits items have been
  demonstrated to work as advertised if assembled correctly; if a kit does not
  work, it is usually because of poor soldering or assembly errors.
 
       
    * If a customer encounters a problem or fault during construction or normal use of
  an ApogeeKits item, it can be returned to our Technical Department for
  examination and/or repair.
 
       
    * If the problem is determined to be a factory fault, it will be repaired and
  returned at factory expense. If the problem is determined to be customer wiring
  error or faulty soldering, repair/replacement will be at customer expense.
  Repair charges will be furnished for Customer authorization before non-warranty
  work is completed.
  Diagnosis of the ApogeeKits Technical Department is final.  Please allow a
  minimum of 3 weeks for examination and/or repair.
 
       
   

* ApogeeKits pre-tests many of our pre-assembled products such as lamps and
  magnifiers and other items before we ship them, to help ensure our customers
  receive working products and reduce the need for unexpected returns.
  However, some delicate user replaceable parts on some of these items, such as
